Groups stymied in attempt at injunction against Makah

For the second time in a month, a federal court has refused to stop this year's Makah whale hunt.

The 9th U.S. Circuit Court of Appeals refused yesterday to issue an injunction to halt the hunt while a lawsuit brought by a consortium of animal rights groups is argued.

The ruling upheld a similar one issued last month by U.S. District Court Judge Franklin Burgess.

The appellate court's ruling was issued early yesterday evening with no explanation or comment, Makah attorney John Arum said.

The Fund for Animals, the Humane Society of the United States and other groups have sued to end the hunts, contending that Makah whaling would endanger human safety and the lives of resident gray whales that remain in the Strait of Juan de Fuca after migrating whales move on.

They also contend that whaling management policies violate the National Environmental Policy Act and the Marine Mammal Protection Act.

The tribe contends that the right to hunt whales was granted to it by an 1855 treaty with the U.S. government. Burgess cited the treaty claim in his denial of an injunction last month.

The Makah hunted whales for centuries off the rugged coast of Washington's Olympic Peninsula before white settlers arrived in the 19th century.

The tribe initiated the process needed to resume whaling in 1994 after the mammals were removed from the Endangered Species List.

The tribe's hunters have since killed one whale, in May 1999.

The International Whaling Commission authorized the tribe last month to continue hunting gray whales and to kill up to four a year.

The courts and the world have lately been showing considerable compassion for the Makah people, after the shit that you and the people you support have put them through.

Thank goodness for that justice is finally being done.

Looks like I was right again ....I don't know why you are taking this so hard, it was no surprise as the outcome was always obvious ... I'm sure you be pissing and moaning about the Makah hunting so late into the season when they issue permits next week but that is your fault and yours alone for not only attempted judge shopping and frivilous court cases stalling it this late but also for expanding the hunting season in because an earlier frivilous lawsuit ...

You are still the Makah's best weapon and *still* to freaking stupid to even figure it out yet ... So what's next? A little terroism and violence because you didn't get your way ... again ... a usual ...
